EARE Response to consultation on the implementation act for the copyright directive in the digital single market in Germany

On 6 September 2019, EARE sent a response to the consultation on the implementation act for the copyright directive in thedigital single market in Germany.

In its response, EARE considers essential to ensure fair access to data the following points:

– The new exceptions created by Article 3 and 4 should explicitly include the reproduction of lawfully consulted works that allow TDM facilitation, for commercial and non-commercial purposes.

– Strict and clear limitations on the reservation of rights by content owners should be established.

– Maintaining a sufficient level of protection for content owners should be guaranteed.
